Il Progetto S.r.l., with registered office in Piazza Italia 11, 23807 Merate (LC), CF/P.IVA 02930270133, REA LC-302316, e-mail [email protected], PEC [email protected], Tel.: +39 039 9909402 (hereinafter, "The project"), through these terms and conditions of use (hereinafter, "T & C”), regulates access to and use of the site websites www.accademiaitalianastyle.com (hereinafter, "Website”) by the User, as defined below.
Therefore, please read these T&Cs carefully.
Access to the Site is offered by Il Progetto to Users free of charge.
The Site is intended for Users who are consumers, pursuant to art. 3 of Legislative Decree 206/2005 (hereinafter, "Consumer Code"), and adults (i.e., over the age of 18 (eighteen) years) (hereinafter, "User / I.").
The User declares, upon accessing the Site, to be of age and consequently to have the ability to use the Site and to interact with its sections and the services offered through the Site itself.
The Project reserves the right to modify the content of these T&Cs at any time to offer new products or services, or to comply with legal or regulatory provisions. The content of the changes and the date of entry into force of the modified T&Cs will be communicated to Users holding an Account, as defined below, by suitable means (by way of example and not limited to, communications e-mail sent to the address indicated when the Account was created), with reasonable notice. Account holder Users who do not accept the changes made to the T&Cs will be allowed to withdraw from the contractual relationship with the Project, by canceling the Account. It is understood that access to the Site and to the Account after the date of entry into force of the modified T&Cs implies the tacit acceptance of the same by the User.
The updated version of the T&C will always be available and easily consultable at the login screen (home page) to the Site. It is advisable to check the T&Cs before each access to the Site.
If improvements or maintenance of the Site are to be carried out, such as to lead to the temporary unavailability of the Site and/or specific pages or sections of the same and/or the services provided through the Site, Il Progetto, where possible, will provide adequate notice to the 'User by communication on the Site (and/or, for Users with Accounts, by communication via e-mail to the address indicated when creating the Account).
The User can access the Site alternatively by free navigation on the browser of your personal device (personal computer, tablets, smartphone, etc.).
The User agrees to access and use the Site in line with these T&Cs.
Failure to comply with the T&Cs by the User could result in the suspension or interruption of access to the Site (and to the services provided through the Site) for, without prejudice to the right of Il Progetto to resort to any further remedy available in compliance with applicable legislation.
- ACCOUNT CREATION
To access the services provided by Il Progetto through the Site (by way of example and not limited to, sales services online, as regulated within the General conditions of Sale– hereinafter, “Services/o”), the User can (i) proceed in “guest” mode (“guest”) or (ii) create a user account complete with personal information (hereinafter, “Account”), using a id user (that is, address e-mail) it's a Password (hereinafter, "Credentials").
For the purpose of finalizing the creation of the Account, the User will also be asked to accept, through flag in the appropriate box, these T&Cs and to read the information on the processing of personal data ("Privacy Policy") and of "cookie policy".
Any additional information and/or actions requested when creating the Account (by way of example and not limited to, information relating to joining loyalty programs / partnerships / membership) are entirely optional: failure to provide the requested information will not affect access to the Site or the creation of an Account by the User.
The User guarantees that the personal data and information entered in the process of creating the Account (as well as in the context of any interaction with the Site and with the Account) are up to date, truthful and correct.
At any time, the User may (i) update and/or modify the Password access to the Account, and (ii) upon request via e-mail at the address referred to in paragraph 9 below, request the cancellation of the Account and of all the information and data transmitted by the User to the Site during his interactions with the same. The Project will meet the User's requests in the shortest possible time and in any case in compliance with the applicable legislation.
The User undertakes not to transfer the Credentials, even temporarily, to third parties and to keep them with due care, diligence, secrecy and under his own responsibility, adopting suitable security measures to prevent access to the Account by third parties unauthorized. It is understood that all acts performed using the Credentials will be attributed to the User, unless the User provides proof to the contrary.
In the event of improper use of the Credentials by the User, Il Progetto may, at its sole discretion, inhibit access to the Account and/or suspend and/or remove the Account itself, without prejudice to the implementation of any remedy permitted pursuant to the applicable law to protect the interests of Il Progetto and/or other Users and/or third parties.
Each User is allowed to open a single Account (therefore, there cannot be multiple Accounts referable to the same Credentials at the same time). In the event that the simultaneous existence of multiple Accounts is detected or reasonably suspected, Il Progetto reserves the right to adopt any remedy available under the applicable law, including the suspension or removal of all Accounts referable to the same User.
The User is required to immediately inform the Project of any (actual, potential or even only alleged) unauthorized or improper use of the Credentials and their Account, and to report any violations (actual, potential or even only alleged) by third parties . The Project reserves the right to adopt any remedy available under the applicable legislation, including the suspension or removal of the Account.
In all the cases mentioned above, the remedial actions taken by Il Progetto (including, by way of example but not limited to, the suspension and/or removal of the Accounts) will be carried out upon adequate notice to the User, unless said notice or said communication are not permitted, prejudice or prevent the implementation of remedies pursuant to the applicable legislation.
- USER OBLIGATIONS
The User undertakes not to use the Site and the Account in a manner different from the provisions of the T&Cs or in such a way as to prejudice, violate or harm the rights of Il Progetto, other Users, or third parties.
The Project reserves the right to undertake any and all actions or remedies available in accordance with the applicable legislation, in relation to conduct that violates the provisions of the T&Cs and/or any other document regulating the contractual relationship between the User and the Project .
The User undertakes to:
- not to make the Site available, for consideration or free of charge, to third parties, or in general to use the Site in any way for commercial, professional purposes or in any case in a manner different from use for an exclusively personal capacity, for navigation and/or use of the Services;
- not to use multiple Accounts and/or not to use the Site and the Account in order to prejudice, limit, modify or otherwise alter access to the Site and/or their Accounts by other Users;
- not to engage in (or attempt to engage in) any conduct - active or omissive - capable, even if only potentially, of interfering with the use of the Site by Il Progetto, or that is capable, even if only potentially, of causing injury or harm, threat, harassment, nuisance or offense to other Users or third parties in general;
- not engage in deceptive, fraudulent or misleading conduct, including Phishing data from other Users' Accounts or the unauthorized use of another User's Account or other Users' Credentials;
- not modify or adapt the Site or alter, modify, adapt, merge, translate, create derivative works of the Site, imitate, tamper with or in any way alter access to the Site;
- not to reverse engineer, decompile, disassemble, decipher or in any way attempt to obtain or derive the object code or source code of any software or other intellectual property used to provide the Site (so-called "reverse engineering");
- not to intervene technically on the Site and/or on its sections or pages, not to remove, deactivate, modify, add or tamper with any program code, source code, object code or data, content of the Site, including any indication certifying the ownership of rights IP (as defined below) within the Site itself;
- not to create software that imitates data or functionality of the Site;
- do not provide hyperlink or other form of connection to the Site for profit or to obtain other economic advantage, without the prior express written consent of Il Progetto;
- not to share the Credentials or other information used to access the Site with Users or third parties;
- not to use the Site for illegitimate, illicit or contrary to mandatory rules, public order or public morals.
The User agrees that the contents for any reason entered or made available in the Account by the User (when customizing the Account, using the functions specifically made available) and also when sharing / publishing on their profiles on social media of the experience of using the Site (through the sharing functions - or similar, depending on the social media used – which will be made available on the various pages and sections of the Site):
- must be lawful and not give rise to civil, criminal or administrative liability either for the Users or for the Project, and must not concern, promote or mention, directly or indirectly, illegitimate, illegal or illicit activities, or activities for which there are restrictions in terms of communication and publication / dissemination of content (by way of example and not limited to, gambling, tobacco products, medicines, etc.);
- must not violate the rights of third parties including, by way of example but not limited to, the rights (including the IP Rights, as defined below) of Il Progetto or third parties;
- they must not contain virus, worms, logic bombs, bugs, malware, spyware, ransomware or other form of data, codes, link o information transmitted, even potentially harmful to the computer systems, operating systems and devices in general that receive them;
- must not be directly or indirectly (that is, not even through mentions, quotations or hints) violent, threatening, abusive, pornographic, defamatory, discriminatory, racist, offensive (including against religious beliefs), obscene or in any case morally reprehensible;
- they must not be capable of causing injury or harm, or of defaming physical and/or legal persons;
- must not aim to organize (or attempt to organize) hate speech groups, or use or promote hate speech (so-called "hate speech");
- must not aim to commercialize or promote on a commercial basis third parties, products or services of any kind and nature;
- they must not be suitable, directly or indirectly, to promote or conclude (or attempt to conclude) meetings for adults (or any interpersonal interaction for even indirectly affective, sentimental or sexual purposes);
- they must not solicit, encourage, invite, support, request, hint, mention or directly or indirectly cause what is indicated in the points above or illegal activities or the violation of these T&Cs.
In the event of conduct differing from the above and/or in any case in violation of these T&Cs, the User will be solely and exclusively responsible and will also hold the Project harmless and indemnified from any liability, charge, cost, expense, loss, sum, fine , indemnity or compensation for damages (including any legal fees) due as a result of the conduct adopted and/or in any case deriving from disputes, complaints, actions (including judicial ones), claims and objections asserted by third parties and/or the competent authorities administrative and judicial.
If there are reasonable grounds to believe that the User's conduct has violated the provisions of this paragraph 3, without prejudice to the implementation of any remedy permitted by applicable legislation, the Project will have, at its sole discretion, the right to suspend, interrupt, block or cancel the User's Account and/or the use of the Service and any content entered by the User into the Account and/or to suspend or terminate the T&Cs.
In the event of such circumstances, Il Progetto undertakes to notify the User with suitable notice (unless said notice or said communication prejudices or prevents the implementation of remedies pursuant to the applicable legislation).
- LIMITATIONS OF LIABILITY - WARRANTIES
Il Progetto is not responsible for any damage, injury, cost, expense or loss, directly or indirectly, attributable to the following circumstances: a) the availability, use and enjoyment of the Site, except in the cases mandatorily provided for by the applicable legislation ( by way of example but not limited to, in the event of willful misconduct or gross negligence or in the event of death or personal injury, resulting from the active or omissive conduct of Il Progetto); b) force majeure events; c) the interruption or malfunction of the services of telecommunications operators and/or power lines, through which it is possible to access the Site and the Services.
Access to the Site, together with any updates and any additional content, are provided "as is", Meaning what "in the state in which they are", as well as "based on availability".
Therefore, to the maximum extent permitted by applicable law, The Project disclaims and does not provide any warranties of any kind in relation to the provision, availability, use and enjoyment of the Site, including, by way of example but not limited to, the warranties implied terms and conditions of merchantability and suitability of the Site for a particular purpose.
The Project does not guarantee that: (i) the Site will meet specific User needs; (ii) the Site is free from defects, malfunctions, bugs, suspensions, interruptions or otherwise without errors; (iii) any defects, malfunctions, bugs, suspensions, interruptions or errors will be corrected / resolved (although the Project will make every reasonable effort to provide access to the Site free from defects, malfunctions, bugs, suspensions, interruptions or in any case without errors, or to resolve or correct them as soon as they become aware of Il Progetto); and (iv) the content and quality of the Site (or information, content, data, news, etc.) obtained by the User will meet the latter's expectations.
No information, news, suggestion or advice that may be provided to the User by Il Progetto in general will constitute a form of guarantee.
Users have the right to inform Il Progetto at the addresses referred to in paragraph 9 below, if problems of access, availability, use or enjoyment of the Site and/or its sections, portions, components and functions are found, in order to allow Il Plan to evaluate, in its sole discretion, to carry out interventions on the Site.
- PERSONAL DATA
The use of the Site involves the processing of the User's personal data. For further information, the User must consult the Privacy Policy , Cookies Policy. - INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS
All industrial and intellectual property rights relating to the Site, including, by way of example but not limited to, trademarks, logos, designs, contents, texts, drawings, know-how, software, data and information contained or connected to them (of followed, overall "IP rights”) belong exclusively to Il Progetto and/or its assignees.
The Project does not grant usage licenses to Users in relation to the IP Rights of the Project, except as indicated in the following paragraphs. Among other things, Users are not permitted to copy, reproduce, translate, modify, distribute, disseminate, communicate to the public, use in any way or form, in whole or in part, the IP Rights of Il Progetto, outside of the activities strictly necessary for the use of the Site.
The User is not granted any right to use the Site for commercial or professional purposes (or in any case for purposes that are not strictly personal), nor any right, option or power to sub-license, assign or transfer the Site to third parties, without the prior express written consent of Il Progetto.
Without prejudice to the foregoing, if the User intends to share information about the use of the Site on their profiles on social media, The Project guarantees a license to use the IP Rights of the Project within the limits of what is necessary for sharing on its profiles on social media.
It is understood that the User remains the owner of the IP Rights relating to the information contained in the Account and/or to the contents made available through the Account. The User grants Il Progetto, for the entire duration of the contractual relationship with Il Progetto, a free, transferable, sub-licensable, irrevocable license, on the information contained in the Account for the exclusive purpose of providing the Service to the User and to others Users.
The Site may include content on which third party rights exist (including IP Rights, personal and personality rights, so-called right of advertising, etc.), or references to third parties. These rights belong to these third parties and no right of use or license is granted to Users through the Site.
- TERMINATION - WITHDRAWAL
The Project reserves the right to immediately terminate, in whole or in part, the T&Cs (by, for example, removing, limiting or canceling the User's Account and/or terminating its access to and use of the Service) in the event of violation by the User of even just one of the provisions contained in paragraphs 3 and 6 above. The related notice of termination will be sent by Il Progetto to the User at the address e-mail entered when creating the Account. In any case of termination, the right of Il Progetto to compensation for damages suffered remains unaffected.
Il Progetto reserves the right to withdraw from the T&Cs, for any reason and at its sole discretion, without the User accruing any right to compensation for damages, penalties, indemnities, reimbursement of costs or expenses. The relevant notice of withdrawal will be sent by Il Progetto to the User at the address e-mail entered when creating the Account.
The User may withdraw from these T&Cs with immediate effect, by requesting the cancellation of the Account through the relative procedure indicated on the Site. In any case, the rights and obligations assumed by the User towards Il Progetto before the effectiveness of the withdrawal. It is understood that the subsequent creation of a further Account (without prejudice to the exercise of the rights pertaining to the interested parties regarding the processing of personal data) will involve the establishment of a new contractual relationship, governed by the T&Cs in force at the time of the new access to the 'Account.
- FINAL PROVISIONS
These T&Cs do not affect the rights granted to the User pursuant to regulatory provisions that cannot be waived, excluded or limited pursuant to the applicable legislation.
Il Progetto reserves the right to transfer the contractual relationships with Users (and their related rights and obligations) pursuant to the T&Cs to third parties, potential assignees of the Site. In this case, Il Progetto undertakes to inform Users of this circumstance with suitable notice.
It is understood that Users are prohibited from transferring the contractual relationship with Il Progetto (and consequently their rights or obligations) pursuant to the T&C.
The immediate failure to exercise (or the delayed exercise) of rights granted to Il Progetto pursuant to these T&Cs and/or the applicable legislation, will not imply acquiescence and/or waiver of such rights (within the statute of limitations and possible forfeiture, as governed by the applicable law).
If any provision, or portion thereof, of these T&Cs is held to be unlawful, void or for any reason unenforceable, that provision, or the affected portion, shall not affect the validity and enforceability of any remaining provisions.
For the purpose of facilitating the out-of-court settlement of disputes relating to contractual obligations deriving from sales or service contracts online (i.e. any contract other than a sales contract under which the trader provides or undertakes to provide a service to the consumer and the consumer pays or undertakes to pay the price thereof) between a consumer residing in the European Union and a trader established in the European Union, please note that complaints must be managed through the dispute resolution platform online, as established by Regulation (EU) n. 524/2013 on dispute resolution online. Il Progetto S.r.l. does not adhere to any ADR body referred to in Articles 141-bis and following. of the Consumer Code.

In the event that the User is not a consumer pursuant to the Consumer Code, the experimentation of the above procedure is not mandatory
These T&Cs are governed by Italian law, with the exclusion of the application of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980.
Without prejudice to the out-of-court settlement of disputes via the dispute resolution platform online (see above), any dispute relating to the execution and/or interpretation of these T&Cs (and, more generally, to the execution and/or interpretation of the contractual relationship between the User and the Project for the purpose of accessing and of the use of the Site), will be devolved to the exclusive jurisdiction of the judge of the place where the User resides or has domicile, in the event that the User is a consumer pursuant to the Consumer Code. In all other cases, any dispute relating to the execution and/or interpretation of these T&Cs (and, more generally, to the execution and/or interpretation of the contractual relationship between the User and The Project for the purposes of access ae of the use of the Site) is devolved to the exclusive jurisdiction of the Court of Milan.
