Terms and Conditions of Sale

  1. SCOPE OF THE CONDITIONS OF SALE
    1. The following terms will have the meaning set out below:
      1. for "Account” means the Customer's personal page on the Site;
      2. for "Client” means the purchaser of the Products, including the final consumer, such as any natural person who purchases the Products for purposes unrelated to his business, trade, craft or profession;
      3. for "Terms of Sale” means this document in the version published at the time of the Order;
      4. for "Brand” means the brand “ACCADEMIA ITALIANA STYLE”;
      5. for "Order” means the purchase order for the Products sent by the Customer via the Site;
      6. for "Product Web Page” means the form available on the Site containing the information of each Product;
      7. for "Products” means the items of clothing and related accessories as well as all the products bearing the Trademark which may be sold by the Seller on the Site;
      8. for "Customer Care” means the assistance service for Customers active from Monday to Friday from 8:30 to 17:30 and reachable via Whatsapp on +39 351 7636732 or via e-mail to the following address: [email protected];
      9. for "Website” means the area dedicated to shop online on the site websites referred to at www.accademiaitalianastyle.com;
      10. for "Territory” means the countries in which the Seller sells the Products, as better listed in the “Countries” section of the Site access menu;
      11. for "Seller" means Il Progetto S.r.l., with registered office in Piazza Italia 11, 23807, Merate (LC), CF/P.IVA 02930270133, REA LC-302316, e-mail [email protected], PEC [email protected], Tel.: +39 039 9909402.
    2. These Conditions of Sale govern the sale to Customers of the Products marketed by the Seller through the dedicated area of ​​the Site, following the procedures indicated therein. The Seller declares to be authorized by Twins Engineering Srl to market the Products with the Brand in line with these Conditions of Sale.
    3. The Customer acknowledges and acknowledges that the Products may be marketed, through the Site, only within the Territory.
    4. To make purchases on the Site, the Customer must, alternatively, complete the registration procedure (by creating an Account) and/or authentication on the Site with their credentials (user id e Password), as best described in the Terms and Conditions of Use of the Site, or proceed as a "guest", according to the indicated procedure.
    5. The Seller invites the Customer to read these Conditions of Sale carefully and to print them or in any case to keep a copy before proceeding with any purchase. In any case, the Seller will send the Customer a copy of the Order with all the necessary information and a copy of the Conditions of Sale via e-mail in line with the provisions of art. 3.5.
    6. These Conditions of Sale apply, in the version in force at the time of the Order, to all Products that are purchased by the Customer on the Site, unless any modifications are required by mandatory provisions of the applicable legislation and/or by provisions issued by the authorities authorities (in such cases, they could also apply to Orders that the Customer has previously placed). In fact, the Seller reserves the right to modify these Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory provisions.
    7. If any provision of these Terms of Sale is deemed invalid, void or for any reason unenforceable, this will not affect the validity and effectiveness of the other provisions. Any changes and/or additions will be effective from the date of publication of the same on the Site and can be consulted at any time on the page websites of the Terms of Sale and downloaded using the relative del command browser.
    8. The offer of Products on the Site is addressed exclusively to Customers. In line with your own commercial, the Seller reserves the right not to process Orders from subjects other than Customers or which in any case do not comply with its
    9. The Seller does not sell Products to minors under the age of 18 (eighteen), who can proceed with the purchase of the Products only through a parent or legal guardian; the Customer assumes all responsibility resulting from any untruthful information in this regard.

  2. PRODUCTS
    1. The essential characteristics and other information of each Product, together with their price, are indicated on the Site within each Product Web Page.
    2. The Customer acknowledges that the graphic representation of the Products displayed on the Site is merely indicative and could be different from reality, just as the colors of the same could not correspond to the real ones due to the browser Internet and monitor The Customer must therefore rely on the description of the Product and on the characteristics of the same reported on the Product Web Page.
    3. The catalog of Products published on the Site is updated by the Seller. The Products displayed on the Site may be indicated as:
      1. "available": these are Products available for purchase and therefore, as such, can be ordered by the Customer;
      2. "unavailable": these are Products that are no longer available and therefore, as such, cannot be ordered by the Customer.
    4. The Products placed in the shopping cart online of the Customer are memorized for 48 (forty eight) hours. After this deadline, the cart will be automatically emptied. If, during this period, the Product selected by the Customer becomes "unavailable", it will be automatically removed from the cart or in any case it will not be possible to proceed with the subsequent stages of the transaction.
  3. METHOD OF SENDING THE ORDER AND CONCLUSION OF THE CONTRACT
    1. The Order is sent electronically after the Customer has completed and confirmed it in the Order summary screen on the Website, as better described in the following paragraphs.
    2. To send an Order, the Customer must:
      1. select an available Product and click on the “Add to Shopping Bag – Your Cart”; more precisely, by accessing the area "My Shopping Bag”, the Customer can, among other things:
        1. view Product and price details;
        2. verify and correct your data;
        3. indicate a shipping location other than the one shown when filling in your personal data. The Customer can also indicate a delivery address other than his own, in which case the Order holder guarantees that he is authorized to communicate the personal data necessary for the identification of the recipient;
        4. change the quantities of the Products or delete the Products added to the cart;
        5. add other Products by clicking on the “Add other products” or returning to the home page and adding further Products to the cart, it being understood that each Order cannot contain more than 10 (ten) Products. Therefore, if the Customer wishes to purchase more than 10 (ten) Products, he must proceed to send a further and different Order;
      2. view the delivery times and any costs foreseen for the same and select the chosen delivery method;
      3. view the available payment methods and select the one chosen;
      4. accept the Conditions of Sale and send the Order by clicking on the "Submit the order".
    3. Before sending the Order, the Customer may at any time view a summary page of the prepared Order, including a summary of the Products, details of prices and any costs, the chosen delivery method, the selected payment method, as well as verify and correct your data.
    4. The sales contract is finalized when the Customer sends the Order to the Seller.
    5. Once the Order has been sent, the Customer will receive a e-mail confirmation of receipt of the Order by the Seller which contains a summary of the information relating to the essential characteristics of the Product, a detailed indication of the price and applicable taxes as well as any delivery costs and a copy of the Conditions of Sale. The Customer may print or save the aforementioned documents using the functions made available by common e-mail programs. If the Customer holds an Account, the Order will in any case be made accessible at any time within the Account itself.
    6. Before shipping the Products, the Customer may modify or cancel the Order:
      1. by accessing your Account and following the relative modification / cancellation procedure, where the Customer is an Account holder;
      2. requesting the modification / cancellation of the Order by means of e-mail, in response to e-mail confirmation of the Order, where the Customer is not an Account holder but has proceeded in "guest" mode.
    7. The Seller will send the Customer a e-mail confirmation of the shipment of the purchased Products. The Customer will be able to monitor the status of the shipment by following the instructions referred to in e-mail that you will receive from the courier appointed by the Seller for the shipment of the Products. After receiving the e-mail confirmation of the shipment of the Product, the cancellation or modification of the Order by the Customer may no longer be possible. In this case, the Customer may proceed with the return of the Products in accordance with the withdrawal procedure set forth in articles 6 and 7 below.
    8. Following the sending of the Order, the Customer accepts that the sales contract is governed by these Terms of Sale.
    9. All Orders are subject to acceptance by the Seller who reserves, at its sole discretion, the right not to process any Order sent by the Customer in the event that:
      1. the data provided by the Customer when completing the Order is incomplete or incorrect;
      2. the Products ordered are not available. To this end, the Seller will not be held responsible for changes in the availability of some Products. If only part of the Products ordered are not available and there are no other causes that may legitimize the non-acceptance of the Order, the Seller may perform the same only for the available Products;
      3. the delivery address of the Products indicated by the Customer is located in a country not included in the Territory.
    10. In the cases indicated above in art. 3.9, the Seller will inform the Customer by e-mail that the Order has not been accepted (in whole or in part), specifying the reasons. In this case, the Seller will reimburse the Customer as soon as possible any sums already paid by the latter, using the same payment method chosen by the Customer when sending the Order.
  4. PRICES AND TERMS OF PAYMENT
    1. The selling prices of the Products, together with the shipping costs and the payment methods, are those shown on the Site and are expressed in Euros. The selling prices of the Products include VAT and any other tax due but do not include the shipping costs, indicated in the relative cart pages, which will be added to the total amount due pursuant to art. 5.5. The Seller reserves the right to change the prices shown on the Site at any time; in any case, the price change will not apply to the Products covered by Orders already sent by the Customer.
    2. The Customer undertakes to pay the price of the Products purchased using one of the following payment methods:
      1. PayPal: the charge will take place at the time the Order is sent and the sales contract is finalised. In case of cancellation by the Customer, the amount paid will be promptly credited back to the same PayPal account;
      2. credit card: at the time of sending the Order and finalizing the sales contract, only a pre-authorization of the expenditure will be made (blocking of ceiling), while the price will be charged using the ceiling blocked, only when the Product is ready for shipment and confirmed with thee-mail of shipment confirmation. It is understood that, in the event of cancellation of the Order by the Customer, the ceiling will be promptly unlocked;
      3. Bank transfer: payment by bank transfer must be made and received by the Seller within 5 (five) days from the date of the Order and completion of the sales contract; in case of non-receipt of payment within the indicated term, the Seller will have the right to terminate the sales contract pursuant to and by effect of art. 1456 of the civil code by sending ane-mail to the client;
      4. other means of payment: including any forms of financing for consumers, made available from time to time by the Seller.
    3. Depending on the Products and/or delivery methods selected, some payment methods may not be available; the Customer must therefore rely on the information provided from time to time.
  5. METHOD OF SHIPPING OF THE PRODUCTS
    1. Before finalizing an Order, the Customer will be able to view the available delivery methods and any costs on the Website.
    2. Depending on the Products selected, some delivery methods may not be available.
    3. For Orders to be delivered:
      1. within the Italian territory, the Seller makes every reasonable effort to deliver the Products to the address indicated by the Customer within 4 (four) working days from the date of finalization of the Order and completion of the contract pursuant to art. 3.4. In any case, for Orders to be delivered within the Italian territory, the Seller declares and guarantees that the Products will be delivered to the address indicated by the Customer no later than 30 (thirty) days from the date of the Order, except in the case of non-payment by the Customer or the request by the Customer for delivery at a later date than the one foreseen;
      2. outside the Italian territory, the Seller makes every reasonable effort to deliver the Products to the address indicated by the Customer within 30 (thirty) days from the date of the Order, except in the case of non-payment by the Customer or the request, by the Customer, for delivery on a later date than the expected one.
        In any case, the shipping, transport and delivery costs are charged to the Customer and may vary according to the Territory (any such costs are clearly indicated to the Customer in the procedure for sending the Order in the Account).
    4. In the event of shipping delays resulting from causes beyond the Seller's control, the Customer will be promptly notified by the Seller's Customer Service.
    5. If more than one Product is added to the cart, the total cost of shipping is indicated when selecting the shipping method and automatically added to the Order total.
    6. The Seller will proceed with the delivery of the Products only after the payment of the price by the Customer.
    7. The Customer (or his delegate), upon delivery of the Products by the courier appointed by the Seller, is required to verify that the packaging and the relative seals are intact, not damaged, not wet or altered in any way and that the number of packages delivered corresponds to that indicated on the delivery document.
    8. Any damage to the packaging and/or to the Product or the mismatch in the number of packages or indications must be immediately notified in writing on the courier's delivery document. Once the courier's delivery document has been signed without the Customer having raised objections, the Customer will not be able to make any objection in this regard, except as provided for in relation to the legal guarantee of compliance with art. 8.
    9. The risks of loss or damage to the Products are transferred to the Customer when the latter has physical availability of the Products, following delivery by the courier.
  6. WITHDRAWAL AND RETURNS
    1. You will have the possibility to return the products within 14 days from the day of delivery. To meet the withdrawal deadline, it is sufficient for you to send the communication concerning your exercise of the right of withdrawal before the aforementioned period has expired.

      To make your return, you will need to i) send a e-mail a [email protected] in which you will declare your intention to return the product/s, with a clear indication of the product/s you intend to return or, alternatively, ii) download, complete and send the return form (available , promising) to one of the addresses indicated on the form itself. We will send you one e-mail in which we will confirm receipt of your notice of withdrawal and the consequent activation of the return procedure.

      You can also request the return of the product with an exchange for another product, or the change of the size of the product ordered. In this case, you must expressly report it in the e-mail or in the return form, providing detailed information about the new product or the new size. We will inform you via e-mail about the availability of the new product or the new size, and about the procedure to follow.

  7. SHIPPING FEES
    1. Shipping, transport and delivery costs are your responsibility and may vary according to the delivery address. Therefore, when sending the order, you will need to indicate the shipping address and you will see the cost of the same.

  8. LEGAL WARRANTY
    1. The sale of products to customers who are consumers is subject to the legal guarantee pursuant to the consumer code.

      To enforce the legal guarantee of conformity, you can download and fill in the form for exercising the legal guarantee (available , promising) and send it to us by sending a e-mail at [email protected].

  9. PROTECTION OF PERSONAL DATA
    1. With regard to all the obligations relating to the collection, processing, of the Customer's personal data and the related purposes, please refer to the specific information contained in the Site.
  10. APPLICABLE LAW AND DISPUTE RESOLUTION
    1. The Conditions of Sale and, consequently, the sales contracts concluded online between the Seller and the Customer are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206 smi (consumer code) and by the legislative decree 9 April 2003 n. 70 as amended on certain aspects concerning electronic commerce.
    2. For any dispute relating to the validity, interpretation or execution of these Conditions of Sale, in the event that the Customer is a consumer pursuant to the Consumer Code, the mandatory territorial jurisdiction lies with the judge of the place of residence or domicile of the Customer. In all other cases, the mandatory territorial jurisdiction lies with the Court of Milan.
  11. ONLINE PLATFORM FOR ALTERNATIVE DISPUTE RESOLUTION (ODR)
    1. Without prejudice to the provisions of art. 10 above, with these Conditions of Sale the Customer is informed that, for the purpose of facilitating the out-of-court settlement of disputes relating to contractual obligations deriving from sales or service contracts online (i.e. any contract other than a sales contract under which the trader provides or undertakes to provide a service to the consumer and the consumer pays or undertakes to pay the price thereof) between a consumer residing in the European Union and a trader established in the European Union, please note that complaints must be managed through the dispute resolution platform online, as established by Regulation (EU) n. 524/2013 on dispute resolution online. Il Progetto S.r.l. does not adhere to any ADR body referred to in Articles 141-bis and following. Of the Consumer Code.

      Further information on consumer rights and procedures under the ODR regulation is available at the same link.
      In the event that the User is not a consumer pursuant to the Consumer Code, the experimentation of the above procedure is not mandatory.
